SWMP Regulations

The Regulations place an obligation on anyone who intends to carry out a construction project with estimated costs greater than £300,000 (excluding VAT) to prepare a SWMP conforming with the Regulations before construction work begins. The Regulations have been the focus of Defra debate over the last 6 months and were originally set to be binned in October 2013.

Defras response to enquiries confirming the date for revocation is currently that the formal repeal is anticipated to be 1 December 2013.
If construction work begins before the repeal date, the legal obligation and a SWMP must be prepared and maintained.

SWMPs may still continue in the future for projects wishing to obtain Code Credits, as site waste management is one of the 9 categories against which a site can be scored, however this will also be dependent on the outcome of the Housing Standards review.
